This website is operated by DSR Automotive Limited ("DSR Automotive", "we", "us"). 

Acceptance of these Terms 

By using this website or placing an order with us, you agree to these Terms of Service, our Shipping Policy, Refund Policy and Privacy Policy (Terms). You confirm that you are authorised to accept these Terms on behalf of the person or entity who is accessing our website and / or purchasing our products. 

Products

Our products are aftermarket parts and accessories, not made or endorsed by any vehicle manufacturer, phone brand or software provider. It's your responsibility to confirm a product is compatible with, and legal for use in, your vehicle before purchasing. Specifications may change, dimensions are approximate, and on-screen images may be simulated.

We reserve the right at any time to modify or discontinue any of the products made available for purchase without notice. We are not liable to you or to any third party for any modification, price change, suspension or discontinuation of the products we offer.

Orders

Cancellation by you: Once placed, orders cannot be cancelled or varied by you without our consent. We do offer a "change-of-mind return" within 30 days of delivery, provided certain terms and conditions are met. You can find these terms and conditions in our Refund Policy.

Cancellation by us: We may refuse or cancel any order (or any part of an order) at any time. For example, this may be because of issues with stock availability, a pricing or listing error, or if we suspected fraud or that you are purchasing products for the purposes of resale. If we cancel your entire order, we will refund the full amount paid, including shipping. If we cancel only part of your order, we will refund the price of the cancelled items only. Shipping costs will not be refunded, as the remaining items will still be shipped to you. We have no further liability to you or any other party in relation to the cancellation of an order or part of an order.

Prices

We may vary our prices from time to time and any variation in price will be published on our website.  The price(s) published at the time an order is placed shall apply to such order unless the products have been incorrectly priced on our website. If a product has been incorrectly priced, we will contact you and you may choose to proceed at the corrected price or cancel your order for a full refund.

Notwithstanding the above, you must pay any costs arising from any variation you make to an order (and which are accepted by us). Payment for any increased costs resulting from a variation is due immediately upon us informing you of acceptance of that variation.  

Payment

You acknowledge that transmissions of information over the internet is never entirely secure and, that while we take precautions to minimise the related risks, we cannot guarantee that any information you provide through our website (including credit card information) will not be accessed by others who breach our security systems. You agree we are not liable for unauthorised access to information through our website by third parties.

You agree to provide current, complete and accurate purchase and billing information for all orders made, and to update such information as necessary.

Installation and use

Installation is the customer's responsibility, and we recommend using a suitably qualified person, such as an auto electrician or mechanic. Incorrect installation or use may cause damage to your vehicle, damage the product and / or result in injury. We're not responsible for any loss, damage, costs or other issues caused by incorrect installation or wiring, modification, installing unauthorised software or firmware, misuse, or use contrary to our instructions.

Vehicle, phone and software compatibility

Features and performance may vary depending on your vehicle's configuration, factory settings, phone and firmware version. Some features rely on third-party phones, apps and software, such as phone connectivity, apps and navigation. These may change or stop working because of updates made by those third parties, which are outside our control. We don't guarantee compatibility with future phone, app or software updates.

Business purchases

If you're buying, or hold yourself out as buying, for business purposes, you agree that:

1. The provisions of the Consumer Guarantees Act 1993 and sections 9, 12A and 13 of the Fair Trading Act 1986 are expressly excluded from the Terms and that it is fair and reasonable to do so; and 

2. all other warranties expressed or implied (including but not limited to those contained in the Contract and Commercial Law Act 2017) and that may be excluded by law are excluded from the Terms to the maximum extent permitted. 

Limitation of liability

Subject to your consumer rights, we're not liable for any indirect or consequential loss, and our total liability for any product is limited to the price you paid for it. We're not responsible for delays or failures caused by events outside our reasonable control.

Your consumer rights

Notwithstanding any other provisions of the Terms, nothing in these Terms is intended to exclude, restrict or modify any rights you have as a consumer under the Consumer Guarantees Act 1993, the Fair Trading Act 1986,  or any Australian Consumer Law, or any other law that can't be excluded.

Intellectual property

All ideas, concepts, technical information, trade secrets, know-how, designs, drawings, copyright material and any other information and intellectual property whatsoever owned or used by us in connection with the operation of the website and the products we provide (Intellectual Property) remains our exclusive property or the property of our licensors. You will not, and will not permit anyone else to, use or copy the Intellectual Property unless we approve in writing.  You will promptly notify us of any infringement of the Intellectual Property.

Site Availability and Security

We do not guarantee uninterrupted access to our website or the security of our website or claim that any information obtained via our website is free from viruses, faults or defects. Our website or any information provided to you may contain links to external websites, plug-ins, applications and other resources that are not operated or controlled by us. Such links are provided for your convenience only and you agree that we make no representations or warranties or have any responsibility or liability for those external websites and you access and use those external websites at your own risk.

General

We may update these Terms at any time. The version on our website when you place your order applies to that order. If we don't enforce any part of these Terms, that doesn't mean we've waived our rights under them.

These Terms are governed by New Zealand law. However, nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law or any other consumer protection laws that apply to you and cannot be excluded.

In the case of any conflict or dispute, these Terms will prevail over any other document or communication between you and us. The headings used in these Terms are included for convenience only and will not limit or otherwise affect the interpretation of these Terms. If any part of these Terms is held to be invalid, unenforceable or illegal for any reason, the remaining provisions of these Terms shall continue in full force.
